The National Planning Policy Framework was published and effective from March 2012. It provides guidance for planners throughout the UK.
However, there is a 12-month period of grace when existing plans need not be altered to bring them into line with framework.
The framework states in paragraph 115: 'Great weight should be given to conserving landscape and scenic beauty in Areas of Outstanding Natural Beauty'. Paragraph 116 states: 'Planning permission should be refused for major development in these designated areas except in exceptional circumstances and where it can be demonstrated they are in the public interest.'
The proposed site known as K5 adjoining West Alvington Hill lies within the AONB.
Development of this site is a major development and is definitely not in the public interest for the many, many reasons previously aired and not repeated here.
As we are in the 12-month period of grace, the planners need not take the above into account when and if planning permission is applied for.
Come March next year, which is only three months away, the planners must take into account the requirements of the framework.
Surely if planning permission is to be refused next March, it cannot be right for it to be granted before then should planning permission be applied for.
